29. Dispute Resolution
Unless you and Mission503, Inc. (“Parties”) agree otherwise, both Parties agree that any dispute, claim, or controversy you may have arising out of or relating to the Website, Services, these Terms, or breach of these Terms, if not resolved first by negotiation will be resolved by the Parties second proceeding in good faith to submit the matter to non-binding mediation before an independent, professional, mutually agreed-upon mediator prior to resorting to litigation or some other dispute-resolution procedure within the state of Oklahoma. Each Party shall bear one-half (1/2) of the mediator’s fees and expenses. If a mediated settlement is reached neither party shall be deemed the prevailing party for purposes of the settlement and each party shall bear its own legal costs.
